Preamble

We invite you to carefully read the General Terms and Conditions of Sale before placing an order. These can be easily and permanently accessed on our website.

The website extreme-tennis.fr is the property of Extreme Tennis in its entirety, along with all associated rights. Any reproduction, in full or in part, is subject to the authorization of the owners. However, hypertext links to the website are allowed without specific requests.

These General Terms and Conditions of Sale (GTC) govern the contractual relations between Extreme Tennis and its customers. By validating their order on the website www.extreme-tennis.eu, the customer accepts these general terms and conditions of sale without reservation. Extreme Tennis reserves the right to modify these conditions. The applicable conditions will be those in force at the date of order validation by the customer.

1. Acceptance of the Conditions

The customer acknowledges having read, at the time of placing the order, the specific sales conditions stated on this page and expressly declares to accept them without reservation.

These general terms and conditions of sale govern the contractual relations between Extreme Tennis and its customer, with both parties accepting them without reservation. These general terms and conditions of sale will prevail over any other conditions appearing in any other document, unless there is prior, express, and written derogation.

2. Products

The photographs illustrating the products are not contractual. If errors have been made, Extreme Tennis cannot be held responsible in any case. The majority of the products offered to customers by Extreme-Tennis are available in our warehouse and shipped by us. If this is not the case, Extreme Tennis undertakes to indicate it on the product sheets in question.

All product references and information are given for information purposes only based on the information provided by suppliers. In no case can Extreme Tennis be held responsible for lack of information concerning products offered for sale on the extreme-tennis.fr website.

3. Order

Automatic recording systems are considered as proof of the nature, content, and date of the order. Extreme Tennis confirms the acceptance of the order to the customer at the email address provided by the customer. The sale will only be concluded upon confirmation of the order. Extreme Tennis reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. The information provided by the buyer when placing the order commits the buyer: in case of an error in the recipient's address, the seller cannot be held responsible for the inability to deliver the product.

RESERVATION OF OWNERSHIP:

Extreme Tennis reserves ownership of the goods until the buyer has paid the price. This right of claim applies both to the goods and their price if they have already been resold (Law of May 12, 1980).

4. Delivery

After order confirmation, Extreme Tennis undertakes to deliver all the references ordered by the buyer to the carrier chosen by the buyer, within a maximum period of 24 working hours. Extreme Tennis reserves the right to use a different carrier in case of force majeure while guaranteeing delivery as chosen by the customer (home, pickup point, or express). The carrier undertakes, through a contract with Extreme Tennis, to deliver the order to the address provided by Extreme Tennis. The customer must take the necessary measures to ensure the reception of the package.

Extreme Tennis reserves the right to deliver your order in several parts, especially if a product from your order is shipped directly by the product's supplier (stringing machine, ball launcher, etc.). Extreme Tennis undertakes to provide the customer with all available tracking information.

The delivery times indicated on the extreme-tennis.fr website are average times given for information purposes. Extreme Tennis cannot be held responsible for delays caused by the carrier.

Delivery Disputes

Goods always travel at the risk and peril of the recipient. Always check your package upon arrival. Our packages are sealed with marked tape, ensuring that the package has not been opened and resealed, allowing you to easily see if there was a problem during transport. Signing the delivery note without reservation to the carrier constitutes acceptance and conformity of the received goods. In case of a problem (damaged box, torn tape, opened package, etc.), please make specific reservations (damaged package, damaged item, etc.), date, and sign on the carrier's document. In the case of a major visible defect that could lead to the loss of an item inside the package, please refuse the package and contact us to open a dispute with the carrier.

In the case of a delivery without a signature, the carrier will confirm the proper delivery of the order.

In the case of packages damaged during transport, the customer must make all necessary reservations on the carrier's delivery note or with the personnel at the pickup point when receiving or picking up the package. If the damage is significant and the warranty tape no longer ensures the proper closure of the package, please check it in the presence of the carrier or at the pickup point. If a product is missing or damaged, please refuse the package.

No claims will be considered for damage occurring after the unreserved signing of the delivery note accepting the order. No return of customized products will be accepted (strung rackets, customized clothing, etc.).

If the received order contains errors, Extreme Tennis undertakes to resend the missing products at its expense and/or send the customer a prepaid return label to return unordered goods. The customer has 30 days after receipt to report any errors. After this period, no claims will be accepted.

All orders placed with Extreme Tennis are intended for the personal use of customers, and customers or product recipients are prohibited from partial or total resale of the products. Extreme Tennis is released from any legal liability if the payment of taxes is not made by the customer.

Delivery will be made after receipt of payment by the carrier selected by the customer. Delivery is made by direct delivery of the product to the announced recipient or, in case of absence, to another person authorized by the customer. Any possible delays do not give the buyer the right to claim damages and interest.

Deliveries in CEE countries are made by Colissimo, UPS, GLS or DPD. For deliveries outside the CEE, deliveries are made by international postal services or Chronopost, depending on the customer's choice.

In the case of a technical product, the customer will particularly ensure the proper functioning of the delivered device and read the provided user manual.
In case of visible defects, the buyer has the right to return the product under the conditions specified in this document.
Events considered as force majeure releasing the seller from the obligation to deliver include war, riots, fire, strikes, accidents, and the impossibility of being supplied.
For availability reasons, an order may be delivered in multiple shipments to the customer. The customer will then pay only one delivery fee. If the customer wants delivery to two locations, they should place two separate orders with associated delivery fees.

5. Right of Withdrawal

The customer has 30 days (from the receipt of the items) to return all or part of their order. To obtain a refund, the customer must return the new item(s) in its (their) original packaging, intact, with all possible accessories, instruction manuals, and documentation to the following address:

EXTREME TENNIS
50 rue Simone de Beauvoir
Cellule 5
59450 Sin le Noble

An intact product is one that has not been used and can be resold as is. In the case of a tennis racket, it cannot be returned if it has been strung. Tennis and paddle rackets cannot be refunded if the grip protection has been removed. Shoes can be tried on to ensure the correct size, but any other use that results in sole marks or other damage will result in a refusal of the refund.

The return procedure is explained on the "Return Procedure" page, permanently accessible on the extreme-tennis.eu website.

The customer must not use the product's packaging as the return container (example: shoe boxes must be packaged in a separate bag or box to avoid using tape or labels on them). Extreme Tennis reserves the right not to accept the return of a customer in case of damaged product or packaging before or during transport. In this case, the customer will be contacted for a reshipment of the products at their expense.

In case of exercising the right of withdrawal, Extreme Tennis is required to refund the amounts paid by the customer, free of charge, except for the return costs. The refund will be made within a maximum of 15 days.

A product customized by the customer cannot be subject to a return or refund request except in case of warranty-related issues.

Customized products include tennis rackets strung by our service at the customer's request through the "CHOOSE A STRING" button or by email request.

In the event that you cancel your order paid via PayPal before it is shipped, please note that we now reserve the right not to refund PayPal commission fees. This decision was made to cover the costs incurred by transactions and cancellations. However, a full credit may be offered to ensure you do not lose the PayPal commission fees.

6. Price

The price is expressed in euros.
The price indicated on the product sheets does not include transportation.
The price indicated in the order confirmation is the final price, including all taxes and including VAT for France and CEE countries. This price includes the price of the products, handling, packaging, and product storage fees, as well as transportation and service fees.

7. Payment

The price charged to the customer is the price indicated on the order confirmation sent by Extreme Tennis.
The price of the products is payable in cash on the day of the effective order.
Payment is made by credit card, PayPal, or bank transfer.
Online, PayPal allows you to pay via a secure banking server.
Furthermore, Extreme Tennis reserves the right to refuse any order from a customer with whom there is a dispute.

8. Disputes

This contract is subject to French law. Extreme Tennis cannot be held responsible for damages of any kind, whether material, immaterial, or bodily, resulting from a malfunction or improper use of the products sold. This also applies to any modifications to the products made by manufacturers. In any case, Extreme Tennis's liability is limited to the amount of the order and cannot be called into question for simple errors or omissions that may have persisted despite all precautions taken in the presentation of the products. In the event of difficulties in applying this contract, the buyer has the option, before any legal action, to seek an amicable solution, notably with the help of:
- a professional association in the industry, a consumer association, or any other counsel of their choice. It is noted that the search for an amicable solution does not interrupt the "brief deadline" of the legal warranty, nor the duration of the contractual warranty. It is reminded that, in general, and subject to the discretion of the courts, compliance with the provisions of this contract relating to the contractual warranty requires that the buyer fulfills their financial obligations towards the seller.
Complaints or disputes will always be received with attentive benevolence, with good faith always presumed in the person who takes the trouble to present their situation. In case of a dispute, the customer will first contact the company to seek an amicable solution.
Failing that, the Commercial Court alone has jurisdiction, regardless of the place of delivery and the accepted payment method. The warranty does not cover shipping costs. Return costs are the responsibility of Extreme Tennis if the product is still under warranty.

9. Warranty

Extreme Tennis cannot be held responsible for non-compliance with the regulatory and legislative provisions in force, and Extreme Tennis's liability is systematically limited to the value of the product in question, at its date of sale, without the possibility of recourse against the brand or the product's producing company.
In any case, the customer benefits from the legal eviction and hidden defects warranty (Art. 1625 and following of the Civil Code). Provided that the buyer provides evidence of the hidden defect, the action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect (Art. 1648 of the Civil Code).

If a problem arises during the warranty period, we invite you to contact our customer service at 09 72 11 33 83.

We inform you that:
- you can come to our store to repair or exchange the product (if it is not repairable).
- you can send it yourself to our store, properly packaged, accompanied by a copy of your purchase invoice and a letter explaining the malfunction.

The warranty does not cover shipping costs. Return costs are the responsibility of Extreme Tennis if the product is still under warranty.

You can contact us 5 days a week (Monday to Friday, from 9:30 am to 12:30 pm and from 2:00 pm to 5:00 pm) at Tel: 09 72 11 33 83, or by email at sav@extreme-tennis.fr.

10. Legal Information

The provision of personal information collected for the purpose of distance selling is mandatory, as this information is essential for order processing, invoicing, and warranty contracts. Failure to provide this information will result in order non-validation. In accordance with the "Data Protection and Freedom of Information" law, the processing of personal information related to customers has been declared to the National Commission for Data Protection and Liberties (CNIL). The customer has the right (Article 34 of the January 6, 1978 law) to access, modify, rectify, and delete the data concerning them, which they can exercise with Extreme Tennis. Furthermore, Extreme Tennis undertakes not to disclose, free of charge or for consideration, its customers' contact information to any third party.
